Regulation 38 of the Building Regulations 2010 (England and Wales)

Regulation 38, part of the Building Regulations 2010 (as amended), focuses on fire safety information. It mandates that the person carrying out building work must provide detailed fire safety information to the “responsible person” (typically the building owner, occupier, or manager) to ensure the building can be operated, maintained, and managed effectively in terms of fire safety. This applies to buildings covered by the Regulatory Reform (Fire Safety) Order 2005, such as non-domestic premises or multi-occupancy residential buildings (excluding individual private dwellings).

Key Requirements

  • When it applies: For the erection or extension of a “relevant building,” or a material change of use that brings the building under the Fire Safety Order.
  • Timing: The information must be handed over no later than the completion of the work or the first occupation of the building/extension (whichever comes first).
  • Purpose: To enable the responsible person to:
    • Carry out an effective fire risk assessment.
    • Operate and maintain the building’s fire safety systems.
    • Review and update the fire risk assessment regularly.
  • Acknowledgment: The responsible person must provide a notice confirming receipt of the information and that it is sufficient for safe management.

What Information Must Be Provided?

The details should cover the building’s fire safety design, construction, and features in sufficient accuracy. Essential information includes:

  • Fire detection and alarm systems (e.g., locations of detectors, control panels, sounders).
  • Fire separation (e.g., compartmentation, fire doors, and their specifications).
  • Escape routes and emergency lighting.
  • Firefighting equipment (e.g., extinguishers, fire mains, hydrants).
  • Signage and maintenance schedules.

For more complex buildings, additional details like smoke control systems or specialist features may be required. The information is often compiled into a “fire safety manual” or strategy document, including as-built drawings.

Recent Updates

As of March 2025, Approved Document B (Fire Safety) has been updated, replacing the previous guidance on Regulation 38 (Section 17 in Volume 1 and Section 19 in Volume 2). These changes emphasize clearer handover processes but do not alter the core requirements.

Compliance and Enforcement

Non-compliance can lead to enforcement action by building control bodies or fire authorities, potentially resulting in fines or restrictions on occupation. It’s a legal handover step, distinct from but complementary to the Fire Safety Order’s risk assessment duties.

As the head of the Birmingham office Paul has overseen diverse, high-stakes projects and led teams to deliver building control services. Known for his problem-solving abilities, Paul has built strong client partnerships and mentored aspiring surveyors throughout his career.
